Right of withdrawal

This page carries the withdrawal instruction and the model withdrawal form for your Relocat account.

1. When this page applies

You register for Relocat through the app, without meeting us in person. We treat your registration as a distance contract with Ruslan Zykun.

Relocat is free of charge. You do provide personal data to us, and German law applies the consumer contract rules to a contract of that kind. (§ 312 Abs. 1a BGB) You therefore receive the same pre contractual information and the same instruction as a paying consumer. (Art. 246a § 1 EGBGB)

Where the law gives you a right of withdrawal for such a contract, the instruction in Section 2 applies. (§ 312g Abs. 1 and § 355 BGB)

We send you a confirmation of the contract on a durable medium with your registration email. (§ 312f Abs. 2 BGB)

2. Instruction on the right of withdrawal

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement. A letter sent by post or an email is enough.

You may use the model withdrawal form in Section 5, but you do not have to.

You can also declare your withdrawal through the withdrawal function in the app, described in Section 4.

To meet the withdrawal deadline, it is enough that you send your communication concerning the exercise of your right of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we must repay to you all payments received from you without undue delay, and at the latest within fourteen days of the day on which we receive notification of your withdrawal.

Relocat asks you for no price, so we have received no payment from you and we have nothing to repay. For the same reason you owe us nothing for the period before your withdrawal.

When we receive your withdrawal, we close your account and delete the data stored under it, as described on the Delete account page.

3. When the right of withdrawal lapses

German law provides that the right of withdrawal for a contract without a price lapses once we have fully performed the service. (§ 356 Abs. 5 BGB) Once that point is reached, you can no longer withdraw.

Closing your account stays open to you at any time, whether or not the right of withdrawal still exists. Section 16 of the Terms of Service and the Delete account page describe that route.

4. The withdrawal function in the app

A trader who lets consumers conclude distance contracts through an online interface must provide an electronic withdrawal function on that interface. The function must be permanently available, easy to find and unambiguously labelled. (§ 356a Abs. 1 BGB)

In Relocat that function is “Withdraw from contract”, in Settings.

The function asks you to confirm your declaration in a second step. Where the law requires it, we then send you a receipt on a durable medium, recording what you declared and the date and time we received it. (§ 356a BGB)
